Brightway Petition: High Court Stays Pole Tax

The Telangana High Court has stayed the notices sent by the Electricity Department officials asking the cable operators to pay Pole Tax. Some cable operators in Medak district, including Shubhodaya Communications (Bright Way), have approached the High Court. The High Court today issued show cause notices to several officials, including the Principal Secretary, Department of Power Infrastructure and Investment, Chairman and Managing Director, Telangana State Southern Distribution Corporation, and adjourned the case till June 6.
Mr. A. Tulasiraj Gokul, appearing for the plaintiffs, contended that it was illegal to issue notices as per Section 4B of the Cable TV Networks Act. The Department of Electricity issued notices to cable operators to pay a total of Rs. 50 per pole plus Rs 15 per month for the use of DISCOM poles. The advocate also argued that the electricity department officials were acting contrary to Right of Way (RoW) regulations. After examining the contents of the affidavit filed by the petitioners, Justice A. Abhishek Reddy issued notices to the authorities adjourning the next hearing to April 6.
Sri Pranav Reddy on behalf of Shubhodaya Communications (Brightway), Sai Cable Network, Sri Ravi Kiran on behalf of Sri Venkateswara Cable Network, Sri Subhash Reddy on behalf of Brightway Communications, Sri Sanda Komaraya on behalf of Sri Mallikarjuka Cable Network, Sri on behalf of Srinivas Cable Network J Srinivas, Shri D. on behalf of Vinayaka Enterprises. The petition was filed by Venkatram Reddy, Shri Bandari Ashok on behalf of Muthyalammathalli Cable Network and Shri Motku Ramesh on behalf of Raj Cable Network filed the petiotion.
Among the respondents were the Principal Secretary, Ministry of Power Infrastructure and Investment, Chairman &, Managing Director, Telangana State Southern Region Power Distribution Company, TSSPDCL CGM, Superintending Engineer, Assistant Engineer, Sangareddy, Additional Assistant Engineer, Ministry of Information and Communication on behalf of the Central Government whom the High Court has issued notices.
