Consumer wins case against ACT Fibernet

Consumer Dispute Redressal Commission has directed the ACT Fibernet to refund the subscription amount of Rs.10,619 and pay litigation cost of Rs, 10,000 for failing to provide high speed internet to a consumer. Complainant Mohd Azam Ali Khan, a resident of Shaikpet, availed the internet services of ACT Fibernet in 2019. He paid Rs. 10.619 as a subscription amount in 2019 for 1000 MBPS internet.
However, the ACT Fibernet provided only 100 to 200 MBPS, which costs only Rs.700. He took up the issue wqith the company but they failed to increase the speed. Later he asked the company to disconnect the service and refund money. ACT Fibernet though promised to refund money and sent a confirmation message and e-mail, it failed to refund the amount. Thought the internet was disconnected, the amount was not refunded.
The complainant said since the company failed to provide high-speed internet, he lost livelihood as he could not make online sand brokings, lost IRCTC ticket bookings and various other online transactions. He said he incurred a loss of Rs.5000-10,000 per day.
ACT Fibernet however contended that due to up-gradation all the customers’ internet connections were disrupted. However, since the complainant did not want to continue with the services, they had sent an e-mail to him intimating that the internet connection will be disconnected and the amount will be refunded within 4 to 6 weeks. The company said another e-mail was sent to the complainant seeking bank account details to enable the refund. “Thought he complainant received the mail, he did not send bank details. Instead, he rushed to this Commission and filed a complaint with the only intention to claim exorbitant compensation” said ACT Fibernet.
After examining the documents and evidence, the commission said CT Fibernet was expressing its willingness to refund the amount. However, instead of coming forward and depositing the amount or paying it to the complainant on the very first hearing, they continued to contest the matter for nearly two years. As such ACT Fibernet is liable to pay the costs. The Commission asked ACT to refund the subscription amount of Rs.10,619 and pay Rs.10,000 as litigation charges.
