TRAI writes to STAR on updation of RIOs

Telecom Regulatory Authority of India (TRAI) has asked Star India Pvt. Ltd to implement the Reference Interconnect Order dated 01.01.2020. This is in response to the representations received by TRAI from several DPOs that they are in receipt of letters from Star intimating that the RIOs be updated which are not in compliance of TRAI’s NTO 2.0. It also asked STAR to furnish compliance report by 30th of this month.

TRAI notified its amended Tariff Order NTO 2.0 on 1st Jan, 2020. However, some broadcasters have challenged the same in Bombay High Court. Though no interim orders were issued restraining TRAI from implementation of NTO2.0, TRAI didn’t take any coercive measures to implement its order since the matter is being heard in Bombay High Court.

In the meanwhile TRAI has received representations from several DPOs that they are receiving letters from STAR India asking to sign the RIOs which are not in compliance with NTO 2.0. While the proceedings in HC are underway, the HC has restrained the stakeholders from implementing NTO 20., said TRAI in its letter.

Since the broadcasters are expected to maintain status quo by way of extension of inter connection agreements entered into with DPOs based on RIOs published by them prior to 01.01.2020 or have to file as per the provisions of amended regulation on 01.01.2020.

Therefore STAR India was asked to maintain status quo as it was prior to 01.01.2020 and withdraw letters sent to DPOs. TRAI has also asked STAR India to furnish compliance report by 30th Sept. 2020 with a warning that action would be initiated if it fails to do so.
